Legal expenses insurance

After moving out, the deposit is withheld. You believe the landlord's deductions are incorrect and want to have them reviewed. Legal protection insurance can cover the attorney and procedural costs. What matters is which areas of life your contract covers and when the dispute arose.

A new contract usually does not cover an ongoing dispute. What "no waiting period" means.

Your everyday life determines the scope

What legal protection do you need?

A contract for motor disputes won’t automatically help you with trouble at work. Legal expenses cover is made up of different areas of life. Many providers bundle several of them; motor legal expenses cover is often available on its own.

Private legal protection

The dealer will not take the defective sofa back. Or an insurance company refuses to provide benefits. The private component can help with such disputes arising from everyday contracts and cover the enforcement of your own claims for damages.

Rental agreements and professional conflicts need a suitable additional component.

Labor law protection

Outstanding salary, a warning or a false employment reference: professional legal protection concerns disputes arising from your employment relationship. This can also include a dispute over termination.

For self-employed people, the protection of their business activities must be checked separately.

Traffic legal protection

After an accident, disputes may arise over compensation, or over defects after buying a car. Traffic legal protection can also apply to pedestrians or cyclists. The contract specifies which persons and vehicles are covered.

Insured defense costs are covered; the policy does not pay fines or monetary penalties.

Tenancy legal protection

This covers, for example, the service charge statement, the return of your deposit, or a rent increase. Owners can arrange suitable housing and property legal protection.

Owner-occupied and rented properties pose different risks. The insured apartment must match the actual use.

Examples from everyday life

Which module covers this?

For guidance, no examination of a specific insured event.

Private legal protection

A privately purchased laptop is defective. No solution can be found with the dealer.

The private module may cover this. For a covered case, the insurer pays for the agreed legal action; it does not reimburse the purchase price itself.

Before taking out the policy

Legal protection insurance without waiting time

Without a waiting period, the protection can take effect from the agreed start of the insurance. This usually doesn't help with a pre-existing conflict, even if the lawyer's letter doesn't arrive until later.

The waiting time is often three months, and in some areas or tariffs longer. It is often not applicable in traffic legal protection. The relevant building block is decisive; The information on the first tariff page does not have to apply to the entire contract.

Simplified example: three months waiting timeWhen protection for new cases can begin
  1. Start of contract

The contract begins now. For this specific add-on, the waiting period applies first.

  2. Three months waiting time

Insurance events that occur during this period are not covered in the example.

  3. A new case afterwards

Cover may apply if the incident and other conditions meet the policy requirements.

A dispute that has already arisen will not be subsequently insured due to the end of the waiting period. The actual deadlines and triggers can be found in the tariff conditions.

When is a dispute considered to have arisen?

This is determined by the conditions for the so-called insured event. Depending on the area of law, it depends on a damaging event or an actual or alleged legal violation. The day on which you go to the lawyer is not automatically decisive.

Therefore, write down the history with the date. The insurer should receive the entire chronology, not just the most recent letter.

What can be covered

What costs does legal protection insurance cover?

In the case of a covered dispute, it bears the agreed legal costs up to the respective limits. This can also apply if you lose the case. You may have to pay a deductible.

Your lawyer
The insured fees are covered, often in accordance with the Lawyers' Remuneration Act. A separate fee agreement with the law firm can exceed this amount. Clarify the reimbursement before you sign it.
Court, witnesses and reports
This may include court fees as well as court-imposed witness and expert costs. A privately ordered report is not automatically included.
Opposing party's costs
If you have to reimburse it in an insured procedure, the insurer can cover it. The cost rules differ depending on the procedure. An important exception concerns the labor court.
Advice and mediation
Telephone legal advice or out-of-court mediation are included in some tariffs. Separate maximum amounts and deductible rules may apply.

Where the usual protection ends

Divorce, inheritance disputes, construction projects and certain investments are often excluded or only covered to a limited extent. For example, an initial legal consultation on family law does not cover the costs of the entire procedure. Strict limits and exclusions also apply to crimes committed intentionally.

Fines, penalties and demands that you have to meet yourself do not become legal costs. So legal protection doesn't just pay your outstanding bill just because you argued about it.

An often overlooked cost rule

Labor law protection: Even winning a lawsuit costs money

In first-instance judgment proceedings before the labor court, each party generally bears its own legal costs. This means you can win your case and still have to pay your law firm. This is governed by Section 12a of the Labor Court Act.

Instance before the labor court
You generally have to pay your own legal fees, even if you win.

A professional component can assume this cost risk in a covered case, even if there is an outstanding salary or a disputed employment reference. If you are a union member, first check the legal protection offered there.

The normal professional module cannot usually be used retrospectively for a termination that has already been given. Like you Ensure deadlines and report the case, is further down.

Premium and out-of-pocket cost

How much does legal protection insurance cost?

The premium appears in the legal protection comparison based on your details. A standalone traffic legal protection differs from a package covering private life, work, and housing. Costs depend on insured parties, deductible, and payment method.

Compare the annual premium for the same scope of coverage. If a monthly price is displayed, check whether you actually pay monthly or if it is just the annual premium converted. Only then can you fairly assess a cheaper rate.

With or without deductible

A deductible reduces your premium, but only choose an amount you can cover quickly in case of a claim. It may apply again per insured event. Policies without a deductible waive this agreed contribution, while other coverage limits remain unchanged.

Some insurers treat telephone advice or mediation differently from court proceedings. These exceptions are set out in the tariff. Our guide to Excess explains how to balance premiums against your own risk.

Legal expenses insurance compared

Start with the disputes you want to prepare for. If you live in rented accommodation, make sure you don't accidentally choose a package without tenant legal protection. If you are self-employed, you need to clarify the protection for your work separately. It's then worth comparing these policy details:

Modules and people
Are your employment relationship, your living situation and the desired family members recorded? When looking at traffic tariffs, also check other vehicles, rental cars and use as a cyclist.
Start and waiting period
The deadline can vary from module to module. Also read how the tariff determines the insured event and deals with previous events. An advertising statement about immediate protection is not enough.
Sum insured and abroad
What amount is available per case? Are there specific limits for certain services or disputes abroad? The duration of a stay abroad can also be limited.
Your share of the costs
Pay attention to the deductible per case and possible special rules for advice or mediation. A different fee agreement can cause additional costs despite the guarantee of coverage.
Help before the trial
In social, tax, and administrative law, review the preceding objection or appeal process. Some policies only cover legal costs in court; others provide legal assistance before proceedings begin.
Dispute over coverage
How are differences of opinion about the prospects of success resolved? The consumer advice center recommends a regulation for the deciding vote. Please also read the procedure and the cost rule in the conditions.

The best legal protection insurance depends on your needs

A test winner is a good reason to look at the conditions. However, the grade applies to the criteria and model customers of the respective test. Check the test date and which components were evaluated. A different tariff may be suitable for a single person with motor legal protection than for a family with a rented apartment.

Who is covered?

Legal protection insurance for the family

A family tariff can include partners and children. The requirements for this vary: for example, a shared household, the name of an unmarried partner or rules regarding the employment of adult children.

It's worth taking a look at your parents' policy, especially when you're studying or training. A separate contract is not always necessary. Coinsurance can end with your first permanent job or other life change; the exact time can be found in the tariff.

Furthermore, joint insurance does not automatically cover disputes between the insured persons. In the event of a separation or move out, it should be clarified who will continue the contract and who needs their own protection.

What to check when moving out

When you need the protection

This is how you report a legal protection case

Have your insurance certificate, relevant contracts, and correspondence ready. A brief timeline helps with the coverage check. Distinguish between the date of the event and the date you received the letter.

  1. Secure deadlines first

Note delivery dates and deadlines. If you are pressed for time, seek legal advice immediately. Reporting to the insurer does not meet a judicial or official deadline.

  2. Request coverage confirmation

If possible, have it clarified in writing before taking any paid steps which activity and which stage of the procedure are covered. The law firm can also submit a coverage request. You must coordinate any urgent time-sensitive steps with them separately.

  3. Clarify lawyer and fees

§ 127 VVG guarantees the free choice of lawyer within the insured remuneration scope. You are not obliged to accept a suggested law firm. However, any fee agreement exceeding the reimbursed fees remains your responsibility.

  4. Coordinate further steps

A commitment to out-of-court activity does not automatically cover every later instance. Before filing a lawsuit, an appeal or a settlement, clarify whether the commitment is sufficient and keep the responses.

Frequently asked questions about legal protection insurance

For whom is legal protection insurance useful?

It can be worthwhile if you do not want to bear potential legal and litigation costs alone and the disputes relevant to you are actually insurable. Check existing coverage beforehand: A union may provide employment legal protection, and a tenants' association may offer advice or additional tenancy legal protection. The scope, waiting periods, and requirements of these offers vary. For individual, manageable questions, it may be more cost-effective to pay for legal advice yourself.

Does legal protection insurance pay in the event of a divorce or inheritance dispute?

In normal tariffs, this area is severely restricted. Often only advice under certain conditions is insured, not the entire divorce or inheritance process. An explicit regulation is required for further services; Special limits and waiting times may apply. A family tariff initially refers to the group of people insured, not comprehensive protection under family law.

Do self-employed people need other legal protection?

For disputes arising from self-employment, appropriate corporate or professional legal protection is regularly necessary. The occupational module for employees does not automatically cover this activity. Even a commercial tariff does not insure every dispute with customers or suppliers. The job description, contractual legal protection and exclusions must suit your company; private protection must be viewed separately.

Is a rented apartment included in rental law protection?

Not automatically. Coverage as a tenant of your own apartment is different from legal protection for you as a landlord. Rented properties and the respective real estate must be expressly insured. The same applies if you rent out another apartment or change the use of an already insured property.

Can I cancel or switch my legal protection insurance?

The term and notice period are stated in your contract. Before switching, you should clarify whether the new insurer will accept you and whether you have seamless coverage. Whether waiting periods are waived or previous events are taken into account depends on the switching rules. Declare previous contracts and prior claims as requested in the application. An ongoing dispute does not simply transfer to the new insurer.

What to do if the insurer denies coverage?

Request a written explanation and compare it with your policy terms. If the insurer rejects your claim due to lack of success prospects or malicious intent, §128 VVG requires an expert or other impartial procedure; the insurer must point this out. Other reasons for rejection, such as an uncovered legal area, must be distinguished. Have the justification reviewed legally if necessary and keep track of ongoing deadlines.
